After the car manufacturer had been accused of getting rid of lawsuit evidence, a United States judge ordered that lawyers, units, and employees of Toyota Motor Corp. preserve every document pertaining to the “crashworthiness” of its automobiles.
A United States district Judge, T. John Ward, wrote that “The court finds an immediate threat of irreparable harm in that, under the allegations, a threat exists that evidence material to this case would be destroyed or altered..”
This order from Ward is due to a federal lawsuit that was filed in Los Angeles in July by one of Toyota’s former in-house attorneys. Dimitrios Biller has made claims that the company destroyed evidence that could have been evidence for possible claims of personal injury. Families of collision victims that had already resolved their claims of product liability were then represented by a lawyer in Texas who sued the Toyota manufacturer.
Todd Tracy, an attorney from Dallas asked for permission from Ward to reopen the cases of his clients’ after Biller’s claims were brought to light, because the suits of some of his clients’ were dropped because evidence was lacking. He represents families of victims who have lost their life and those who have been paralyzed. Tracy has asked for unspecified sanctions and damages against Toyota on these families behalf.
In an email of a Toyota spokesman, Mike Michels, stated Toyota had no comment concerning Ward’s order. Toyota has stated that they meet all ethical and legal standards and have ‘acted appropriately’ in the way they manage claims of product liability and lawsuits.
On Sept. 17 as a response to the claims made by Bill, Michels stated “We remain confident that we have acted appropriately.”
Based on the lawsuit filed against Toyota in July, Biller stated that the illegal and unethical tasks that he was forced to do led to his resignation from Toyota and a mental breakdown that caused him to not to be able to work. When Biller left the manufacturing company in 2007, he obtained a settlement in the amount of $3.7 million dollars.
There has been a hearing that is set for Oct. 7, for Ward to make the decision whether or not to extend the order he has put in place. If you were injured and need a Toyota recall attorney, contact Ehline Law at 888-400-9721.
