Pennsylvania Students Mother Files Fourth Wrongful Death Claim Against Toyota

February 25, 2010 (by Horatio Algren) According to reports a mother has filed the fourth wrongful death claim against Toyota in connection with her child’s death. The mother of a 21 year old University of Pittsburg student that was killed in a single vehicle crash has filed the fourth wrongful death claim against the automaker.

The federal lawsuit was filed in Los Angeles, California and alleges the vehicle had a defect in the electronic acceleration system. The vehicle that Tyrene Livingston was killed in was not one of the 8.5 million vehicles that has been recalled according to reports.

Livingston had complained to the dealership employees that the breaks on her 2007 Yaris hatchback were not working properly. After allegedly checking the vehicle’s breaks they stated there were no problems.

Four days after the dealership employees checked the vehicle’s breaks Livingston was traveling to an internship on October 26, 2007 she was fatally injured. Livingston who was pronounced dead at the scene of the accident had been traveling in the right hand lane when the vehicle crossed all three lanes of the highway. The Yaris then crashed through a highway barrier traveling into the woods, with Livingston sustaining major injuries.

The wrongful death lawsuit was filed by Sandra Livingston February 22, 2010 and the papers filed claim the automaker should have provided mechanical linkage between the accelerator and engine in a way that the brake could override the system.
Toyota refused to comment on the pending wrongful death claim.

Honda Recalls Autos Over Airbag Inflators

February 10, 2010 (by Horatio Algren) According to reports by a Honda injury attorney, the automaker Honda is now recalling some models of their vehicles. The recall that began in November 2008 is expanding and according to Honda there have been 12 incidences of the airbag inflators deploying with too much pressure.

This causes the inflator to break, which can send metal fragments through the airbag cushion. According to Honda this defect in the airbag inflators has caused at least one fatality. There were less than 4,000 2001 Honda Accords and Civics involved in the original recall, after that recall there were two more incidences of ruptured airbag inflators reported.

One of the reports was for one of Honda’s models not included in the recall. The recall was expanded in July 2009 to include not only the 2001 and 2002 Accords and Civics, but also certain 2002 modles of Acura TL Hondas. The latest recall announced February 10, 2009 has been expanded to include certain 2001 Honda Accords, Odyssey, CR-V and some 2002 Acura TL models, the additions to the recall now total 378,758 Honda’s.

Woman Brings Suit Against Newport Beach After Being Hit

February 1, 2010 (by Horatio Algren) According to reports a 24 year old woman that was struck by a taxi cab has filed a suit against Newport Beach.

Brandi Lynn Sutton has filed a legal claim against the city for an accident that occurred on West Balboa Boulevard at 26th Street. The accident occurred in August at approximately 2:00 a.m. when she was struck by a taxi cab while crossing the street in a crosswalk.

Sutton a Costa Mesa resident sustained injuries including a broken leg in the accident and alleges that the crosswalk was poorly lit, along with other factors in the $2.2 million suit against Newport Beach. Sutton claims the crosswalk lines paint is faded and the streetlight was not working creating a dangerous crosswalk on public property.

A witness to the accident stated that the streetlight located on the northwest corner was not on at the time of the accident and came on intermittently afterwards. The witness also stated that Sutton was in no rush to reach the sidewalk prior to the accident.

City officials rejected the claim for $2.2 million leaving Sutton the choice to file suit.

Rapper Found Guilty In Pedestrian Death

February 1, 2010 (by Horatio Algren) According to reports a Swedish rapper that struck a pedestrian during a November 2008 accident was found guilty of striking a pedestrian and road rage.

Rapper and record producer David Jassy was found guilty Monday of second degree murder. Jassy who is facing 15 years to life in prison struck 55 year old John Osnes after punching and kicking the jazz pianist.

Osnes was pronounced dead at the hospital after being struck by Jassy’s SUV in a Hollywood crosswalk, and Jassy was arrested after investigators traced the license plate of his rented SUV.

Judge Monica Bachner denied reduction of bail stating due to Jassy being a flight risk as a Swedish citizen, having an 11 year old child in Sweden, a brother in Italy and relatives in Gambia, leaving his bail at $1 million and Jassy remaining in jail.
