Can Whiplash Result In A Traumatic Brain Injury

Many of my clients know I love heading to Florida. I really need to get out there and visit my buddy, Matthew A. Dolman, Esq. He is a lawyer buddy of mine over at G+ and we like to discuss the differences between Florida and California law. I asked him to speak here at the lawsuit center. So here goes. Matt says that:

As a Tampa Bay personal injury attorney, I have noted that a number of my clients whom have suffered whiplash mechanism acceleration/deceleration injuries have also manifested with symptoms indicative of a traumatic brain injury. Claims adjusters and insurance defense lawyers have long propounded the myth that one must strike their head or lose consciousness in order to suffer a brain injury.

A recent study published in the July 2010 issue of the journal Brain injury,
(Chiari and Whiplash Injury co-authored by Ezriel Kornel, M.D.,
F.A.C.S., and Michael D. Freeman, Ph.D.) illustrates that an acceleration/deceleration (whiplash) mechanism injury may result in anatomical changes to the brain itself that can result in a mild traumatic brain injury or even a life threatening brain injury such as a Chiari malformation.
The authors investigated the case files and 1200 cervical (neck) MRI’s of
patients with chronic and persistent neck pain caused by whiplash.  In 23% of the
cases, patients with whiplash were found to be considerably more likely to suffer anatomical changes to the brain, specifically in the form of a herniation to the brain known as a Chiari malformation.  A Chiari
malformation is a herniation of the brain (cerebellum) that dips through
an opening at the base of the skull after a whiplash injury.

How Does Whiplash Cause A Brain Injury

The brain is described by many medical practitioners as having the consistency of pudding. In an automobile accident, the brain itself continues moving after either the head stops by impacting a stationary object or in an acceleration/deceleration mechanism injury like whiplash (i.e. think of shaking baby syndrome). In acceleration/deceleration automobile accidents wherein the skull does not actually strike an object, it has been concluded by many physicians that the brain may bounce off of the skull and impact the opposite side. This often results in what is known as a coup/contrecoup injury.

Within the brain there are countless nerve calls located within the gray matter, which communicate with, communicate with other distant nerve cells through nerve fibers known as axons. Coup contrecoup injuries are linked closely to diffuse axonal injuries often leading to permanent cognitive limitation.

During an acceleration/deceleration automobile accident or motorcycle accident (whiplash), the head moves in a violent and rapid manner. As a result, the fragile axonal fibers can twist, stretch and tear. Automobile accident victims, suffering from mild to moderate closed head injuries, will clinically present with issues such as difficulty staying on task, lack of attention and concentration. Further, such individuals often face difficulty with higher level thinking (known as “executive functions”) involving organizing, planning, problem solving, and abstract thinking, and making judgments. As a result such individual may now experience vocational issues and become unable to attain gainful employment.

As a Florida traumatic brain injury attorney, I cannot stress just how important it is for an injured party who manifests with symptoms indicate of a closed head injury to retain an attorney experienced in handling brain injury claims. A competent traumatic brain injury attorney keeps up to date on the latest developments and changes in both science and caselaw surrounding this rapidly evolving area.
