Multi-Vehicle Injury Crash on the 57 Freeway Backs Up Morning Traffic

January 31, 2012 - According to reports by a Los Angeles personal injury attorney at Ehline Law Firm PC, a multi-vehicle crash on the 57 Freeway tied up morning traffic and injured at least one person. According to the California Highway Patrol the collision occurred at approximately 5:40 a.m. and involved three vehicles on the 57 Freeway.

California Highway Patrol Officer P. Gomez said three vehicles were involved in the collision in the vicinity of Lambert Road, blocking the three left lanes. Officer Gomez stated the collision involved a Mazda, a Ford pickup truck and a BMW. The Mazda it is believed veered toward the left, while traveling southbound and stuck the Ford pickup.

The force of the impact caused the truck to hit the BMW, officer Gomez said.
The Ford pickup then crossed all lanes toward the right shoulder of the 57 Freeway and went down an embankment. Officer Gomez said the impact caused the BMW to hit the center divider, causing one person to be injured. The person was transported to an area hospital, with unknown injuries, that were believed to be minor.

According to the California Highway Patrol the three southbound lanes of the 57 Freeway were clear by approximately 6:08 a.m.

Four Year Old Injured in Hit and Run---Police Searching for Driver

January 26, 2012 - According to reports police are searching for the driver of a hit and run accident that injured a four year old.

According to police the accident occurred at approximately 8:00 p.m. at South Avenue 54 and South Terrace 52nd Street in Highland Park. The four year old that was struck by the vehicle described as a 1999 or 2000 white Ford F150 was seriously injured, when family members say he ran out into the street. The boy was transported to USC County Medical Center.

According to the child’s uncle Julian Ramirez the driver stopped for a few seconds before speeding away from the scene. The driver police say has been described as a man wearing a baseball cap and driving a white Ford F150 pickup truck with pink taillights and a camper shell.

Man Killed in Hit and Run Accident in San Bernardino

January 24, 2012 - According to reports a man was killed in a hit and run accident Sunday. According to the California Highway Patrol a pedestrian was struck by a vehicle and found lying on the side of San Bernardino Avenue in the vicinity of Commerce Street in Fontana at approximately 3:35 a.m.

The San Bernardino Coroner’s Office has identified the pedestrian, who was pronounced dead at the scene of the accident as Victor Joseph Scallo age 44 of Huntington Beach.

The California Highway Patrol is currently searching for the driver that struck Scallo, killing him and leaving the scene of the crash. They stated that no witnesses have come forward in the incident.

Wet Roads Blamed for Multiple Crashes

January 23, 2012 - According to reports wet roads have been blamed for multiple Monday accidents in the Brea area.

According to Fullerton Police Lt. Lorraine Jones there were multiple Monday morning accidents in the county due to wet roads. A 12:30 a.m. crash involving a BMW crashed into the center divider on Bastanchury Road in the vicinity west of State College Boulevard. Firefighters had to cut off the driver’s side door of the vehicle in order to extract the driver that was transported to the hospital with minor injuries.

California Highway Patrol Officer R. Gonzalez said at approximately 7:10 a.m. there were reports of two separate accidents in the vicinity north of Tonner Canyon Road. One report was the driver of a Honda Accord that slid causing the vehicle to go up an embankment and rollover. The second accident involved a Ford Escape that crashed on Brea Canyon Road. CHP officer Gonzalez said both drivers were traveling to fast for roadway conditions.

According to the California Highway Patrol, at approximately 10:30 a.m. a collision occurred on I-5 involving a big rig and two vehicles in the northbound lanes. The crash blocked the No. 3,4 and 5 lanes of the freeway.

Woman Killed in Crash After Husband Fell Asleep Driving

January 19, 2012 - According to reports a woman was killed when her husband fell asleep driving.

According to Los Angeles Police Department Sgt. Kurt Smith, the accident occurred at approximately 5:50 a.m. on Vanowen Street, in Canoga Park.

Sgt. Smith said the vehicle was traveling west on Vanowen Street when the man fell asleep driving and hit a parked car and then smashed into a tree.

The man has been identified as Leonides Ricalde, who was driving the couple home after working the graveyard shift.

The wife, whose name has not been released was not wearing a seatbelt at the time of the crash. Ricalde and a bystander pulled the woman out of the vehicle.

According to Sgt. Smith, the woman was pronounced dead at the scene of the crash and there were no drugs or alcohol involved in the cause of the crash.

Fatal Collision on the 22 Freeway Results in DUI Arrest in Garden Grove

January 17, 2012 - According to reports a fatal collision that occurred on the 22 Freeway in Garden Grove resulted in one driver being arrested on suspicion of driving under the influence.

According to the California Highway Patrol the collision occurred on Sunday in the eastbound lanes of the 22 Freeway from the I-405 southbound lanes at approximately 7:00 p.m. The California Highway Patrol said three vehicles were involved in the collision, a Toyota Camry, Toyota Corolla and a Jeep Liberty.

The driver that was pronounced dead at the scene of the car crash was identified as Aida Gonzalez age 53, who was driving the Toyota Camry and stopped on the inside shoulder of the divider that separated the eastbound lanes of the 22 Freeway from the southbound lanes of the I-405.

The Corolla was struck by the Toyota Corolla that was traveling in the No.1 lane and swerved to the left for unknown reasons, hitting the back of the Corolla. The impact sent the Camry spinning into the path of an oncoming Jeep Liberty, according to the California Highway Patrol.

California Highway Patrol officials said the driver of the Liberty slammed on their breaks, but could not avoid the collision. The driver of the Corolla was identified as Charline Vilchis age 21 of Long Beach, who was arrested on suspicion of driving under the influence.

Solo Vehicle Crash Kills Three in Paramount

January 13, 2012 - According to reports three people were killed in a solo vehicle crash in Paramount.

According to authorities the solo vehicle accident occurred at approximately 1:00 a.m. on Downey Avenue and Summerset Ranch Road in Paramount. The accident police said was caused when the vehicle that they believe was traveling between 90 and 100 mph struck a curb, hit a light pole and then struck a fire hydrant. The vehicle identified as an SUV burst into flames.

Police stated that there were six people inside of the vehicle and five of the six people were ejected during the ejection car crash. Three of the people were men and three were women and reportedly friends, police said, with investigators saying that they were in their 20’s and 30’s.

Three people traveling in the vehicle were killed in the crash, including the driver, police said. Police said that it is unclear if alcohol played a role in the crash and it is difficult to know if the people in the vehicle were wearing seatbelts at the time of the crash.

According to police the cause of the crash remains under investigation.

According to reports photographer Grigor Balyan has filed a lawsuit against Lindsay Lohan for injuries that were suffered in a January 2010 accident. According to Balyan’s attorney Neil Steiner, Balyan was struck by a car driven by Lohan’s assistant when she was leaving a club. Steiner stated that Lohan is named in the lawsuit because, while she was not the driver, she was directing the driver.

Balyan who attempted to settle with Lohan’s insurance company is asking for reasonable compensation for orthopedic and neurological injuries that he suffered.

Vehicle Crashes Through Doughnut Shop Injuring One Person

January 10, 2012 - According to reports one person was injured when a car crashed into a doughnut shop.

According to Orange County Fire Authority Capt. Marc Stone the accident occurred at approximately 9:50 a.m. in the vicinity of the intersection of Western Avenue and Katella Avenue in Stanton.

Capt. Stone said it is not clear what caused the vehicle to crash into the shop and it is still under investigation. According to Orange County Sheriff’s Department Lt. Roland Chacon said that Lori Wertz age 53 and a resident of New Mexico turned into the parking lot of the doughnut shop and drove into the building. Lt. Chacon said they are unsure why she was unable to stop.

Lt. Chacon stated that a male customer in the doughnut shop was injured when the vehicle crashed into the building. Capt. Stone said the man sustained a large cut to his right forearm and was transported to UCI Medical Center in Orange for treatment. He stated that the driver was shaken up in the crash, but was uninjured.
The driver was not cited in the crash, until the investigation determines that she should be, according to Lt. Chacon.

Elderly Driver Dies After Orange Collision

January 7, 2012-According to reports an 85 year old man died from injuries he suffered in a collision on Friday.

According to Orange Police Sgt. Dan Adams the collision occurred at approximately 1:30 p.m. when the elderly driver turned off of Santiago Canyon Road in the eastbound lane into the Holy Sepulcher Cemetery. The man was identified by the Orange County Coroner’s office as Guillermo Preciado age 85 of Santa Ana.

Preciado was driving a Toyota Camry that was struck by a Honda Accord that was traveling westbound on Santiago Canyon Road. Sgt. Adams stated that Preciado was transported to UCI Medical Center in Orange, where he died several hours later from the injuries he suffered during the collision.

Investigators were notified of the 85 year olds death by the Orange County Coroner’s Office at approximately 8:00 p.m. The Orange Police Sgt. said that it is not clear if Preciado’s death was caused by the injuries or a medical condition.

Stand-Up Comic Killed and Another Seriously Injured by Suspected Drunk Driver

January 5, 2012 - According to reports one standup comic was killed and another seriously injured in a crash by a suspected drunk driver.

According to police the accident occurred on January 3rd at approximately 12:40 a.m. at the intersection of Hollywood Boulevard and Argyle Avenue. Police stated that the Hollywood collision caused fatal injuries to stand-up comedian Angelo Bowers and seriously injured comedian Josh Adam Meyers. Bowers was transported from the scene of the crash to an area hospital where he died a few hours later.

Meyers is still hospitalized and recovering from his injuries. The driver identified as a 21 year old that was driving under the influence of alcohol struck a second car approximately five minutes after the first crash on Vine and Yucca Streets. The drunk driver and the driver of the other vehicle were seriously injured.

According to police the driver is expected to be charged with driving under the influence and the death of Angelo Bowers, when he recovers enough to be charged.

Orange County DUI Arrests Higher During New Years than in 2010-2011

According to the California Highway Patrol the number of suspicion of driving under the influence arrests in Orange County was up this year over the previous New Year’s. Between Friday night at 6:00 p.m. and Sunday at 6:00 a.m. the California Highway Patrol logged 57 arrests for suspicion of driving under the influence. That number is up from the same period during the 2010-2011 New Year’s holiday period when there were 20 fewer DUI arrests made.

According to the California Highway Patrol there were 932 DUI arrests made statewide and 12 deaths. No traffic related deaths have been reported in Orange County. During the 2010-2011 holiday period the California Highway Patrol stated there were 873 arrests made.

Skateboarder Dies From Injuries in New Year’s Eve Hit and Run Crash

January 1, 2012 - According to reports a 19 year old skateboarder died from injuries suffered during a New Year’s Even hit and run crash.

According to the Lake Elsinore Police Department the crash occurred at approximately 6:45 p.m. in the 1500 block of Lakeshore Drive in Lake Elsinore.

Police stated that the 19 year old was riding his skateboard westbound on Lakeshore Drive when he was struck from behind by a vehicle that fled the scene.

The 19 year old that has not been identified suffered traumatic head injuries and multiple fractures when he was struck, according to the Lake Elsinore Police Department.

The injured man was treated at the scene by paramedics and transported to Inland Valley Medical Center, where he died from the injuries he sustained in the crash on New Year’s Day.

The Lake Elsinore Police Department is asking for help from the public in finding the vehicle and driver that struck the skateboarder. They urge anyone with information to contact the Lake Elsinore Police Department.

Driver Hits La Habra Locksmith Booth—Police Investigating Possible Alcohol Link

December 27, 2011 - According to reports police are investigating the cause of an accident involving a driver that drove into a La Habra locksmith booth. According to La Habra Police Department Sgt. Jeff Baylos the accident was reported at approximately 2:00 a.m. at the intersection of Whittier Boulevard and Beach Boulevard.

The driver of a vehicle crashed into a traffic pole and a portion of the vehicle was crashed into the booth of the Crest Lock and Key in La Habra, Sgt. Baylos said. According to Sgt. Baylos the accident is being investigated to determine if the driver was under the influence at the time of the crash.

The locksmith booth, according to new owner and partner of Green Security, Chad Luettgerodt said that the building has been there for 43 years and their company had just purchased it from the original owners.

Sgt. Baylos said that no one was in the building at the time and the driver was transported to an area hospital after complaining of pain.

Twelve Year Old Girl Killed When Struck on the 60 Freeway in Riverside County

December 26, 2011 - According to reports a 12 year old girl was struck and killed on the 60 Freeway in Riverside County. According to the California Highway Patrol the accident occurred on Sunday at approximately 11:00 p.m. on the 60 Freeway in Riverside County. The accident occurred in the westbound lanes of the freeway in Mira Loma, in the vicinity east of Wineville.

The 12 year old has been identified as Eunice Flores of Riverside, who was struck by a 1991 Mercedes 300E. According to the California Highway Patrol Flores was attempting to retrieve belongings that had fallen off of the Chevrolet Suburban she was traveling in as a passenger.

The driver identified as John Sullivan age 74 was traveling at approximately 70 mph, when he saw the girl in the westbound lane of the 60 Freeway and was unable to avoid hitting Flores. The 12 year old Flores was pronounced dead at the scene of the crash, the California Highway Patrol said.

Sullivan the driver of the Mercedes was not arrested and he was not injured in the collision. There has been no information released about the occupants of the Chevrolet Suburban and the California Highway Patrol is continuing their investigation in the collision that resulted in Flores fatal injuries.

Los Angeles County Sheriff’s Deputies Injured In Crash with Woman with No Headlights On

December 23, 2011- According to reports two Los Angeles County Sheriff’s deputies were injured in a crash, with a woman that did not have her headlights on. According to Los Angeles County Sheriff’s Sgt. Debra Herman, the collision occurred at approximately 10:00 p.m. Thursday night on Foothill Boulevard.

Sgt. Herman stated that the deputies served to avoid a car that had pulled out in front of them in the vicinity of Moore Street. The vehicle that was involved with the deputies was traveling in the opposite direction, when they served to miss the vehicle pulling out.

The driver, identified as a woman did not have her headlights on at the time she pulled out, causing the deputy driving to hit a wall and a telephone pole, Sgt Herman said.

Sgt. Herman stated that it does not appear that alcohol played a role in the woman driving without her headlights on, and authorities question if she was distracted.
According to the Glendale Police Department Sgt. Tom Lorenz, they are continuing to investigate the accident.

The two deputies, whose names have not been released, were transported to the Verdugo Hills Hospital. Sgt. Herman said, both were treated and released, with the deputy that was driving suffering a severe sprained wrist and a possible separated shoulder. The other deputy that was a passenger had an injury to his left leg. The two deputies said that the accident could have been much worse and that they are glad they did not hit the woman’s vehicle. They believe their injuries would have been more severe if they had not been wearing their seatbelts.

Woman Injured in Overturned Car Crash Crawls to Roadway

December 20, 2011 - According to reports a woman that was injured in a crash that caused the car to rollover in Corona crawled to the roadway for help. According to California Highway Patrol they received reports at approximately 11:30 p.m. of a car traveling the wrong way on Interstate 15 in the vicinity of Temescal Canyon Road.

The California Highway Patrol stated that officer drove to the area, but did not find the vehicle or the driver. According to California Highway Patrol the woman that was injured in the crash crawled approximately 100 yards to the side of Temescal Canyon Road. The woman was found by a worker that called 911.

The worker stated that the woman had a broken ankle that was bleeding and was suffering from other injuries. The unidentified worker said that he called the woman’s mother that came to the scene and accompanied her daughter to the hospital.

The injured woman was transported to Inland Valley Medical Center Hospital, according to the California Highway Patrol. The California Highway Patrol said that they are unsure of what caused the accident and do not know if alcohol was a factor.

Unlicensed Driver Strikes and Kills a Pedestrian in Panorama City

December 19, 2011- This is another tragic event that we see a lot around he holiday season. According to reports an unlicensed driver struck and killed a pedestrian in Panorama City. According to police the accident occurred at approximately 5:35 a.m. Saturday on Woodman Avenue in the vicinity south of Cantara Street. The questions the prosecutor will ask, is are inter alia: (1) What is your legal status; (2) was your license suspended; (3) Were you drinking?

Police officials stated that the pedestrian that was struck and killed has been identified as Patricia Ellen Riedy age 60 of Wildwood, Mo. According to police Riedy was crossing Woodman Avenue and was not in a crosswalk when she was struck by a Ford Explorer SUV.

Police said the driver of the Ford Explorer was Martha Cruz age 36 and was alleged to be driving without a license, but was not arrested at the scene of the crash. Riedy was pronounced dead at the scene of the crash by paramedics, according to authorities.

According to police Los Angeles Police Department detectives from the Valley Traffic Division are investigating the fatal pedestrian crash. It appears there was no alcohol or drugs, as the driver was not taken into custody. In any event, there are two isues here for purposes of this post: (1) the criminal aspect; (2) the wrongful death aspect.

The Criminal Aspect

Man Flees From Three Vehicle Crash with Injuries

December 19, 2011 - Here is a great story about a guy who runs away from the scene. According to reports a man fled the scene of a three vehicle crash that resulted in injuries. According to Anaheim Police Officer Danny Mihalak the accident occurred at approximately 10:50 a.m. in the vicinity of Euclid Street and Catherine Drive in Anaheim.

Officer Mihalak said that the three vehicles were involved in the 3 car collision, including a Honda Civic and a Chevrolet Cavalier. The Honda was traveling southbound on Euclid Street, when the Chevrolet made a left hand turn in the path of the Honda. This caused the Honda to be pushed off of the road and into a Chevrolet Tahoe that was parked.

The driver of the Civic, identified as a woman was injured in the collision and transported to an area hospital. The woman’s 1 year old child was not injured in the collision, according to his father that came to the scene of the crash and identified the woman as Monica Varillas age 21.

According to Officer Mihalak, the driver of the Cavalier that struck the Honda took off from the scene of the crash on food and was later spotted at a 7 Eleven store, but has not been caught.

Freeway Hit and Run Crash Injures Motorist and Causes SigAlert to be Issued

December 12, 2011 - According to reports a motorist was injured in a hit and run crash. According to the California Highway Patrol the hit and run accident occurred at approximately 5:03 a.m. in the westbound lanes of the 22 Freeway in the vicinity of the Magnolia Street exit.

The California Highway Patrol said a SigAlert was issued at approximately 5:48 a.m. and ended at about 7:18 a.m. The motorist that was involved in the hit and run crash was transported to UCI Medical Center, with unknown injuries, the California Highway Patrol stated.

Downtown Los Angeles Seven Car Pileup Blocks Two Lanes of the 110 Freeway

December 9, 2011 - According to reports a seven car pileup on the 110 Freeway in Downtown Los Angeles blocked two lanes of the highway.

According to the California Highway Patrol Officer Christian Cracraft a seven car pileup occurred at approximately 2:17 p.m. in Downtown Los Angeles north of Hill Street. CHP Officer Cracraft said that the seven car collision blocked two of the three northbound lanes on the 110 Freeway.

The officer stated that there was a Metro bus at the scene, but it is unclear if it was involved in the collision.According to Officer Cracraft a SigAlert was not issued, but that it would take approximately 30 minutes to clear the scene of the crash and traffic is stopped all the way to the 10 Freeway.

Teen Struck Crossing Street in Critical Condition—Driver Arrested for Suspicion of DUI

December 7, 2011 - According to reports a teen crossing the street after school was struck and is listed in critical condition. According to the Newport Beach Police Department a 17 year old student was struck, while crossing the street Tuesday, after school.

Newport Beach Police Department spokeswoman Kathy Lowe the 17 year old student was struck at approximately 2:50 p.m. while crossing an intersection bordering to Newport Harbor High School. The student was struck by a black Chevrolet Tahoe that was traveling northbound on Irvine Avenue at Margaret Drive.

According to Lowe the student was in a crosswalk at the time that she was struck by the Tahoe and was transported to Western Medical Center in Santa Ana, where she is listed in critical condition. According to Newport Beach police the driver of the Chevrolet Tahoe, identified as Marnie J. Lpppincott age 38 of Costa Mesa, was arrested on suspicion of driving under the influence.

According to Lowe investigators are continued to investigate the accident Tuesday evening blocking off the area. The multi-vehicle collision involved three vehicles and an AC Transit bus, according to the California Highway Patrol.

Lanes of 60 West Closed After Collision

November 30, 2011 - According to reports three lanes of the 60 West Freeway were closed after a collision. According to the California Highway Patrol a collision occurred at approximately 6:40 a.m. on 60 West and at the 605 connector.

The California Highway Patrol closed the three right lanes on the 60 West Freeway and two right lanes on the 605 Freeway south connector. They stated that the traffic was backed up to Azusa Avenue on the 60 West Freeway.

According to the California Highway Patrol the collision involved at least six cars and a big rig, with injuries reported. CHP officials did not know the extent of the injuries.

November 30, 2011 - According to reports a La Habra man was killed in a solo vehicle crash in Fullerton. According to Fullerton Police Lt. Lorraine Jones the deadly accident occurred at approximately 11:43 p.m. Tuesday in the 1500 block of North Harbor Boulevard.

Lt. Jones said that officers found a 1191 Chevy Blazer that had slammed into a tree. Fullerton police believe the SUV was traveling north on Harbor Boulevard when it veered off of the road, striking the tree. Supervising Deputy Coroner Larry Esslinger stated that the man that was fatally injured in the SUV crash has been identified as Jorge Carrillo age 46 of La Habra.

Fullerton Police Sgt. Andrew Goodrich stated that they are unsure what caused the accident, but an autopsy is planned to help determine if there was a medical issue or if alcohol or other substances played a role in the crash. Lt. Jones said Harbor Boulevard was closed until approximately 7:00 a.m. from Brea Boulevard to Bastanchury Road, while police investigated the crash.

The cause of the recalled is due to contaminated brake fluid, involving certain models of both vehicles. The Chrysler Motor Corp. and the NHTSA recall will involve a total of 340 vehicles.

The recall that has been issued is due to possible contaminated hydraulic brake fluid that can deteriorate the affected vehicle’s brake seals. This could result in brake seal failure and loss of braking power.

According to the National Highway Traffic Safety Administration this issue could cause a risk of collisions.

Chrysler Motors Corp. will begin notifying the owners of the affected vehicles included in the recall in December. Owners will be able to take the vehicles to their local dealership and mechanics will replace the contaminated brake fluid and brake components.

Orthodox Jewish Activist Killed Struck By Vehicle and Local Rabbi Critically Injured

November 22, 2011 - According to reports an Orthodox Jewish activist was killed and a local rabbi critically injured in Larchmont.

According to authorities the two were struck at approximately 6:20 a.m. Tuesday morning at the intersection of Oakwood Avenue and North La Brea Avenue, outside of the Bais Yehuda Shul Synagogue.

The Orthodox Jewish activist has been identified as Dov Landau age 80 from Los Angeles, who was killed when struck. The rabbi that was transported to Cedars Sinai Hospital is listed in critical condition.

The two men were struck in front of the Synagogue after leaving an early morning prayer service, according to authorities.

The accident caused La Brea to be closed between Beverly and Rosewood Avenues, while police investigated the scene. Drivers were directed to other roadways, to avoid the car accident scene.

According to the California Highway Patrol the driver of a Ford Escort lost control of the car, at approximately 11:40 p.m. Saturday night, while traveling eastbound on Hasley Canyon Road in the vicinity of Commerce Center Drive.

The driver lost control on an S-curve, causing the vehicle to veer off of the road and crash through a wooden fence, sheering a large tree and coming to rest on a hillside.

According to the California Highway Patrol a seventeen year old boy that was sitting in the front seat, was ejected from the Ford, and suffered serious injuries.
Two other teens were killed in the crash, and have been identified as Kevin Sanchez age 16 and Richard Lagunas age 19.

The driver has been identified as Carlos Hernandez age 28, who survived the crash, was seriously injured. Hernandez and the 17 year old was transported to Henry Mayo Newhall Memorial Hospital.

According to the California Highway Patrol it had just rained and left the roads slick prior to the accident. The California Highway Patrol now things that alcohol could have played a role in the Saturday night crash. Hernandez faces arrest after recovering, for suspicion of driving under the influence, according to the California Highway Patrol. They stated that the three passengers were not wearing seatbelts at the time of the crash.

November 17, 2011 - According to reports a morning solo crash on the I-5 off ramp at Magnolia Avenue resulted in one person being injured. According to California Highway Patrol Officer Jose Perdomo the accident occurred at approximately 10:30 a.m. at the I-5 off ramp at Magnolia Avenue in Buena Park.

Officer Perdomo stated the driver of a Ford Ranger pickup truck lost control of the truck while exiting the I-5 Freeway, causing the pickup to rollover. According to the California Highway Patrol officers at the scene of the Buena Park rollover crash, the driver said he had been blinded by the sun prior to losing control and hitting the right shoulder guardrail before the pickup overturned.

The driver of the Ford Ranger pickup was transported to Western Medical Center to be treated for his injuries, according to CHP Officer Perdomo.

November 14, 2011 - According to reports a pedestrian that was struck by a vehicle in Fullerton was severely injured.

According to Fullerton Police Sgt. Andrew Goodrich both police and firefighters received reports to respond to Rosecrans Boulevard at Emery Ranch Road, after a pedestrian had been struck, at approximately 5:30 p.m.

The pedestrian was struck by an SUV in the vicinity of Ralph B. Clark Park, according to Fullerton police.

According to the Fullerton Police Department the injured pedestrian has been identified as a woman in her early 30’s.

According to Fullerton Police Lt. Tom Basham the female pedestrian was transported to UCI Medical Center in critical condition.

Sgt. Goodrich the woman was struck when crossing Rosecrans and the driver remained at the scene and talked to police. It was not clear if the woman that was struck was in a crosswalk at the time she was struck by the SUV.

There have not been any arrests made in the incident and Fullerton police do not believe that alcohol or drugs were involved. Rosecrans was closed in both directions while the scene was investigated from Emery Ranch Road to Gilbert Street.

Pedestrian Struck in Anaheim Fatally Injured

November 5, 2011 - According to reports a pedestrian that was struck by a vehicle and later died from the injuries.

According to Anaheim Police Sgt. Bob Dunn a pedestrian was struck at approximately 7:00 p.m. Friday night in the 3300 block of West Lincoln Avenue. The pedestrian identified as a man in his 80’s was struck by a Kia, whose driver remained at the scene of the crash.

The Orange County Coroner’s Official stated that the elderly man was transported to UCI Medical Center in Orange, where he died in under an hour after his arrival at the hospital.

Sgt. Dunn stated that the driver of the Kia remained at the scene and spoke with investigators and the Anaheim police do not believe that alcohol was a factor in the accident. As many of you know, I like to blog a lot. But I wanted to have a guest from another state talk about an important issue. So my friend at Miller and Zois, Ron Miller is guest posting as follows: One of the biggest harms in a serious personal injury case is past and future lost wages. When an injured personal injury plaintiff loses earnings or earning capacity, the value of this loss must be calculated. Past earnings are verified through wage statements and other methods, such as pay stubs, W-2’s and income tax returns. Estimates of future losses are based on medical prognosis.

There is some degree of debate about whether wage loss should be determined based upon the claimant’s gross or net wages. When the employee loses sick time, seniority, health insurance or other benefits, the gross figure is likely most appropriate. This is particularly true in jurisdictions that adhere to the “collateral source rule” which states that in determining damages, it is irrelevant whether the claimant has been reimbursed from a source other than the tortfeasor, such as sick time, short-term disability insurance or the like.

This analysis is more complicated where the claimant is self-employed or where a significant portion of their income is commission-based. For the self-employed, the measure of the past loss often depends on proof of their lost profit. This will usually require an expert opinion based on past profitability, as compared to profitability during the period of disability, taking into account costs and market factors. If the claimant is self-employed in a new business venture, insurers will steeply discount any claimed losses if they accept them at all, since there are no prior results that may be used as a comparison point to determine the lost profit.

Long term losses require particular care. The insurance carrier - particularly in car accident cases - carefully considers whether the injured person may resume any type of employment, and if so, when. For claimant’s counsel, proving future wage loss requires a combination of factual evidence and expert opinion. A medical expert will need to address the claimant’s physical abilities.

A vocational expert will address the claimant’s ability to seek and obtain employment in the marketplace, and an economist will be needed to translate all of this information into a number that represents the present value of the future losses. Insurers know what to look for on a claim of this type, and are unlikely to offer settlement money for these kinds of losses without the proper documentation. Carriers may be expected, except in the most obvious situations of total and permanent disability, to claim that the injured person may perform some occupation or can be trained to fill one. If the carrier has some evidence to support either position, it reduces the settlement.

Woman Killed in Silver Lake Car Crash

Two Women with Strollers Struck by Car in Santa Ana

November 4, 2011- According to reports two women pushing strollers were struck by a vehicle in Santa Ana. According to Santa Ana police Cpl. Anthony Bertagna two women pushing strollers were struck by a vehicle in downtown Santa Ana. The accident occurred at approximately 5:00 p.m. when they were crossing the street, where there was no crosswalk on Civic Center Drive.

Cpl. Bertagna said the mother and an adult niece were crossing the street with three children, a one year old, a three year old and a five year old. The driver of the car has been identified as Linda Kakala, who struck the women and the strollers. Kakala stated she did not see the women crossing with the children.

Kakala stopped the vehicle as soon as the accident occurred and had to move the car, when it was apparent that a three year old was pinned underneath of the vehicle. According to Cpl. Bertagna the 3 year old was pinned underneath of the vehicle and the driver had to move the vehicle. The two women, the three year old and the one year old were all seriously injured in the accident. The five year old was not injured when the others were struck by the vehicle.

According to authorities the driver of the car was transported to the hospital due to a medical condition, not due to injuries from the accident. Kakala stated the car accident was awful and she was glad there were no fatalities.

How does Bankruptcy Affect an Accident Settlement?

When an accident leads people into serious financial trouble, they often file for the petition of bankruptcy. Filing bankruptcy as a result of accident has its own effects, like for example, the proceeds of any settlement becomes the property of the bankruptcy estate. Now whether or not you can keep the settlement proceed with you that depend upon where you live, how much money you get, and when the accident occurs.

There is a fundamental concept in bankruptcy law that during the bankruptcy proceedings, the estate becomes the legal owner of debtor’s tangible and intangible assets. The estate may include the piece of land owned by the debtor, car or a collection of artwork. The estate may also include the property to which the debtor is entitled but has not received yet, such as tax refunds or law suit settlements. However, there is a provision to protect the property in bankruptcy by exempting it from the estate, but that depends upon the kind of property and the area where it is located.

There are certain federal laws of exemption which you can utilize to protect your property from the bankruptcy estate. Section 522 of the bankruptcy code provides such list of exemption. In case of the proceedings of an accident, exemptions depend upon the type of accident you meet. As of February 2011, you can exempt upto 21,625 that you received for your personal injury. But you cannot exempt the amount you received for pain and suffering or pecuniary loss. On the other hand, if your settlement is for wrongful death then you can exempt as much amount as is necessary for you to protect yourself. Section 522 of the bankruptcy code also includes a provision called wild card exemption which you can use to exempt any of your property.

Aside from federal exemptions, bankruptcy code also includes a list of state exemptions that you can use to protect your property from the bankruptcy estate. However, there is also a provision in bankruptcy code that allows states to opt out of federal exemptions altogether, and there are many states who have chosen to do so. So if you live in such a state then you cannot use the federal exemptions at all.

The primary impact of chapter 7 bankruptcy on accident settlement is that during the petition of bankruptcy, estate can take away any portion of the settlement that you cannot exempt. And if during the bankruptcy you do not yet receive the settlement, then chapter 7 estate can take over the settlement negotiation. He will then give you your exemption as the proceeds he receives. On the other hand, the impact of bankruptcy chapter 13 on accident settlement is that the non-exempt amount will decide how much will you going to pay to the unsecured creditors and thus the payment plan may be higher as a result.

However, in case of chapter 7, if the accident occurs after you file for the petition of bankruptcy then the entire amount of settlement is yours, since you were not entitled to any proceeds at the time you had filed for the petition. But in chapter 13, no matter when the accident took place, you may have to give your proceedings to the estate with which they will pay off your outstanding obligations. You can protect the money provided you being able to prove that you need it to support yourself and your family.

Driver Involved in Collision with an SUV Owned by Kelly Thomas’ Father Arrested for Suspicion of DUI

October 13, 2011 - According to reports by a car accident lawyer at Ehline Law Firm PC, a collision involved an SUV owned by Kelly Thomas’ father, resulted in the other driver being arrested for suspicion of driving under the influence. According to Fullerton police the accident occurred at approximately 4:30 p.m. on Wednesday in the parking lot of Steamers Café on Commonwealth Avenue.

Ron Thomas, father of homeless man Kelly Thomas, who died after an altercation with Fullerton police in July, was attending a town-hall meeting that was hosted by Councilwoman Sharon Quick-Silva when the accident occurred. According to Fullerton police Robert Hossein Ghanadian struck three parked vehicles in the Steamers Café parking lot. According to Fullerton Police Capt. Robert Bastreri, after the crash Ghanadian was unable to pass a field sobriety test. Ghanadian complained of pain, but refused to be treated by paramedics.

Thomas stated there was a large police presence after the driver suspected of driving under the influence struck the vehicles to ensure it was not deliberate action against Thomas.

Thomas has organized weekly protests and has attended City Council meetings since the death of his son, demanding justice and accountability. Thomas’ son Kelly Thomas died after an altercation with several police officers that have since been charged with his death. Officer Manuel Ramos was charged with second degree murder and involuntary manslaughter. Cpl. Jay Cicinelli was also charged with aggravated manslaughter in Kelly Thomas’ death. October 10, 2011-According to reports a multi-vehicle collision on the 57 Freeway, clogging up traffic. According to the California Highway Patrol the multi-vehicle crash occurred at approximately 6:55 a.m. on the 57 Freeway in the southbound lanes in the vicinity north of East Imperial Highway.

According to California Highway Patrol Officer J. Sanchez, the crash was a chain reaction collision involving three vehicles in the No. 2 lane. It involved a Mercedes Benz that was struck by the driver of a Lexus 350, causing the Mercedes to be pushed into a Toyota Camry.

September 19, 2011 - According to reports a head-on crash in Camarillo left four people dead and one person in critical condition. According to Ventura County fire officials a head-on crash was reported at 6:00 a.m. on a two lane road.

September 15, 2011 - According to reports a three vehicle collision on the I-5 Freeway caused injuries to one woman.

According to the California Highway Patrol the collision between two cars occurred at approximately 6:15 a.m. in the vicinity north of the Brookhurst Street exit in Anaheim. Both cars, one being identified as a silver Toyota Camry were merging into the same lane.

September 12, 2011 - According to reports a man was fatally injured during a car crash that resulted in him being pinned between two vehicles. According to the Irvine Police Department a 77 year old man was fatally injured Monday morning when he became pinned between two vehicles. Driver Arrested in Rialto Hit and Run Death of Teen Skate Boarder

September 5, 2011 -According to reports a driver that was involved in a hit and run death was arrested Monday. According to Rialto Police Department Lt. Randy DeAnda, driver Matthew Cory Hudson age 21 was arrested in the death of a teen skateboarder.

The deadly hit and run occurred in the 400 block of Home Street, where Jonathan Olagues was riding his skateboard along the side of the street. Hudson is alleged to have sped through the neighborhood at approximately 8:00 p.m. hitting Olagues and then fleeing the scene of the crash. According to Lt DeAnda Olagues was pronounced dead at the scene of the hit and run.

Hudson then reported his vehicle stolen at 2:30 a.m., which Lt, DeAnda stated is not uncommon in hit and run accidents. During a police interview Hudson made statements that caused officers to believe he was the driver of the 2001 Chevy Camaro that was involved in the hit and run that fatally injured the skateboard rider.

August 31, 2011 - According to reports one person was injured in a two vehicle collision Wednesday morning.

According to authorities the two car collision occurred at approximately 7:00 a.m. Wednesday morning at the intersection of Filipe Road and Camden Road in Mission Viejo.

According to Anaheim Police Sgt. Bob Dunn a Friday head-on crash occurred in the 2700 block of West Ball road that was fatal for a woman.

The head-on Anaheim car accident collision happened at the intersection of Ball Road and Magnolia Avenue.
There were three moving vehicles and two parked vehicles involved in the fatal crash, as stated by police. Anaheim Coroners officials have identified the driver in the fatal head-on crash as Dellene Burgeson age 51 of Anaheim.

Sgt. Dunn said, witnesses reported that Burgeson, who was driving a Lincoln, was traveling westbound on West Ball Road, when her vehicle crossed the divider into oncoming traffic. The Lincoln Bergeson was driving struck a Mazda and overturned. The man in the Mazda was transported to the hospital with critical injuries.

According to authorities a passenger van carrying approximately 15 elderly passengers was involved in a collision at approximately 9:00 a.m. Thursday. The collision occurred in the vicinity of the 6600 block of North Wilbur Avenue near Kittridge Street and involved two other vehicles.

According to Los Angeles Fire Department spokesman Matt Spence, the elderly passengers were from the Genesis Adult Day Health Care and more than a dozen people were injured in the motor vehicle collision that remains under investigation. Seven of the elderly passengers were treated at the scene and released, with seven others being transported to local hospitals to be accessed and treated for their injuries. According to the Orange County Coroner the woman killed in the multi-vehicle crash was identified as Elizabeth Eddleman a resident of Irvine. According to police the multi-vehicle collision invoved a 2010 BMW coupe traveling on Rosa Drew Lane that was struck by a 2003 Mercury Mountaineer that was driving west on University Drive. Eddleman, the 22 year old that was killed in the fatal motor vehicle collision was driving the BMW. There was a postal truck and a minivan that were at the intersection.

Authorities stated that Eddleman had to be cut from the car and was transported to the hospital in critical condition, where she later died. Police stated the driver of the Mountaineer struck the driver’s side of the BMW, which caused both vehicles to veer into the postal truck and minivan at the intersection.

The driver of the SUV was identified as a 26 year old woman from Corona del Mar, who was transported to the hospital in serious condition. According to authorities her injuries are not believed to be life threatening.

No one in the minivan or the postal truck was injured in the multi-vehicle crash.

Jim Griffin the rollover crash occurred at approximately 5:30 a.m. on Imperial Highway in the vicinity west of Berry Street. While traveling in the westbound lanes, authorities believe that while the Honda CR-V was traveling westbound, Zepeda struck a fence on the north curb, between Berry Street and Viking Avenue.

The vehicle involved in the rollover crash was a 1990 Honda CR-V hatchback, that critically injured a teenager and the driver sustained minor injuries. According to Sgt. Griffin, firefighters had to remove a teenage boy that was trapped in the back seat of the vehicle. The teen was transported to UCI Medical Center in Orange with a lacerated spleen and a skull fracture, Griffin stated.

May 31, 2011-According to reports during the Memorial Day weekend there were 148 arrests for driving under the influence. According to Orange County Deputy Wayne Howard between Friday and Monday night between checkpoints and patrol saturation there were 148 arrests for suspicion of driving under the influence made. It is unclear how many of these arrests involved a car accident with injuries.

The count could grow higher, since some agencies have not reported their figures yet, said Wayne. According to Deputy Howard this number is up from the same period during the 2010 holiday weekend when there were 139 arrests for driving under the influence.
The holiday weekend campaign this Memorial Day was a combined effort of multi-agencies, including the Orange County Sheriff’s Department and the California Highway Patrol. The task force was known as Avoid the 38.

April 11, 2011 - According to reports a multi-vehicle crash caused the southbound lanes of the 405 Freeway. According to the California Highway Patrol the multi-vehicle crash blocked No. 1, 2 and carpool lanes of the southbound lanes of the 405 Freeway.

The accident was reported to the California Highway Patrol at approximately 8:44 a.m. in the vicinity north of McFadden Avenue in Huntington Beach. The multi-vehicle crash involved a Ford Thunderbird that was struck by a Nissan Altima and then rear ended by Toyota Echo.

According to the driver of the Nissan Altima, Jiten Bhakta age 22, the driver of the Ford Thunderbird slammed on their breaks to avoid hitting a van that was stalled and he was not able to stop in time to avoid hitting the Thunderbird. The California Highway Patrol stated that the van pulled over on the side of the freeway and it is unclear if it was involved in the multi-vehicle crash. April 5, 2011-A morning collision caused a vehicle to become trapped underneath of a 7-UP truck.

According to the California Highway Patrol Officer Dana Haskin a car crash was reported at approximately 9:35 a.m. with witnesses stating a vehicle was underneath of a 7-UP truck.

Officer Haskin stated that a passerby helped to remove the driver from a Nissan that was pinned under the truck. The passenger side was wedged underneath of the trailer with just enough room to get the driver out.

According to Officer Haskins the driver was alert, but could not remember what happened and was transported to a local hospital. The crash is under investigation and witnesses have stated the Nissan swerved across lanes and went under the 7-UP truck that was traveling in the No. 2 lane.

March 30, 2011-According to reports a driver suspected of DIU struck a police car early Wednesday morning. According to Garden Grove Police Sgt. Otto Escalante the accident occurred at approximately 1:40 a.m. at the intersection of Haster Street and East Orangewoord.

At the time of the collision police had another vehicle stopped for suspicion of driving under the influence, when according to Sgt. Escalante officers heard a vehicle hitting parked cars. The vehicle identified as a green 1994 Ford F-150 turned onto Orangewood missing one police car, but striking the back of another police car.

The police car that was struck had the driver from the traffic stop in the back. Police stated the Ford pickup truck did not have its lights on when it turned onto Orangewood.

After hitting the police car the driver of the pickup attempted to flee on foot, but according to officers at the scene the driver fell face first on the road. March 28, 2011-According to reports two paramedics were injured in Los Angeles after a hit and run crash. According to Los Angeles Police Officer Tony Travato, of the South Traffic Division, two Los Angeles firefighter paramedics were injured in a hit and run crash in Watts.

March 24, 2011 - According to reports a woman believed to have been driving under the influence of alcohol. According to the California Highway Patrol Officer Jennifer Connolly, the crash occurred on the Long Beach 710 Freeway in the vicinity north of the westbound Glenn Anderson Freeway at approximately 12:02 a.m.

The 24 year old woman was believed to have been driving under the influence of alcohol at the time she crashed driving her car under a tow vehicle carrying a truck in Lynwood. Officer Connolly stated the woman was pronounced dead at the scene at 12:20 a.m.
California Highway Patrol officers at the scene stated the woman had been drinking with her boyfriend when they got into an argument. The boyfriend told officers he had been following her on the freeway.

CHP officers were investigating whether the boyfriend was chasing the 24 year old at the time of the Long Beach car crash. He was taken into custody after admitting to officers that he had been drinking.

According to officer Connolly, while the California Highway Patrol investigated the accident, all the southbound lanes of the freeway were blocked until 2:45 a.m.

According to Orange County Sheriff’s Department Lt. Ted Boyne the accident occurred Monday at approximately 11:37 a.m. on El Toro Road in the vicinity of Glenn Ranch Road.
Deputies and firefighters responded to the scene and found two people were trapped inside of a Porsche after it rolled over in the two car collision.

January 21, 2011-According to reports a fatal hit and run leads to beating of another driver. The events of the mob beating and fatal hit and run occurred at approximately 9:30 a.m. on Crenshaw Boulevard near the 105 Freeway in Hawthorne.

A fatal hit and run left one man dead and another pedestrian injured when she attempted to help the man. The man was outside of the crosswalk when he was struck by a southbound driver of a white or grey minivan that fled the scene, leaving the man laying in the street, when he was struck by another driver that failed to stop.

The woman was struck when she ran to the man to help and was struck by a motorist traveling southbound. The driver stopped to render aid, but instead was attacked by a mob of bystanders. The Anaheim woman identified as Nicole Davenport age 23 was involved in a collision at a Lake Forest intersection Friday.

According to Sheriff’s Deputy Wayne Howard , the collision occurred in when Davenport was traveling westbound in a 2009 Hyundai on Bake Parkway, making a left hand turn onto Northpointe Drive. A 2007 Toyota Tacoma was traveling eastbound on Bake Parkway and struck Davenport’s Hyundai on the passenger side.

Sheriff’s Deputy Howard stated one of the vehicles ran a red light causing the collision, but it is unclear which vehicle ran the light.

According to Howard, the Anaheim woman was transported to Mission Hospital where she was pronounced dead.

According to Orange County prosecutors the driver charged in a deadly crash identified as Luicci Nader age 19 of Huntington Beach has been charged with one felony count of vehicular manslaughter, by an unlawful manner of driving with gross negligence.

The 19 year old is being held on $100,000 bail and made his first court appearance Friday and was scheduled to appear in court to be arraigned in March.

The vehicular manslaughter charges stem from a December 24, 2010 car crash, on the Coast Highway. January 16, 2011-According to reports a vehicle that smashed into an apartment building is now suspected to be a suicide attempt.

According to authorities a car crashed into an apartment just after 5:00 a.m. Saturday in the 1700 block of South Pacific Avenue. Police suspect the woman driving the car that slammed into the apartment building and crashing though the wall of a bedroom was attempting to commit suicide.

According to police the woman struck a parked car nearly severing it in two and then struck a tree prior to crashing into the apartment building. The crash started a small fire that was quickly put out and threw a sleeping man out of bed and into a closet.

Alex Pudenz stated he was sleeping when the car crashed into his bedroom throwing him into a closet. He heard the woman screaming and had to climb over her car to get out of his apartment.

January 10, 2011 - According to reports, two people were killed in separate weekend freeway crashes.

According to California Highway Patrol Officer Denise Quesada, two people were killed in weekend crashes, with one that occurred at 3:41 a.m. Saturday killing a 34 year old Tustin man. The accident occurred when the man was traveling on southbound on the 55 freeway in the vicinity south of the 22 freeway. The 34 year old crashed into the wall on the right shoulder and then into a light pole.

The second fatal accident occurred at 4:30 a.m. on Sunday on the northbound lanes of the I-5 freeway in the vicinity north of Crown Valley Parkway. The accident involved a 1997 Crown Victoria collided with the left rear side of a 2007 Ford Edge. The collision caused the Crown Victoria to spin around and was then struck by the Ford Edge and then traveled into an embankment, where it rolled over several times.

According to the California Highway Patrol the Crown Victoria was traveling at a high rate of speed in the No. 1 lane, when the driver made an unsafe turn into the No. 3 lane. The driver was identified as a 24 year old man from Costa Mesa. The passenger in the Crown Victoria was not wearing a seatbelt and was ejected from the vehicle. The woman’s identity has not been released pending notification of her next of kin, but coroner’s officials have stated the fatally injured passenger was an 18 year old woman.
